      Objective of the Discussion

      The objective of the study is to understand the role of Adjudication in conflict resolution.

      Learning Outcomes

      After attempting this activity students will be able to understand the concept of Adjudication in conflict resolution.

      Point of Discussion (POD)

      Adjudication is the legal process by which an arbiter or judge reviews evidence and argumentation including legal reasoning set forth by opposing parties or litigants to come to a decision which determines rights and obligations between the parties involved.

      Being a student of Conflict Management subject, which form of adjudication method is considered as the least preferred method and why does it use as the last option for conflict resolution?

      Justify your answer with an example by mentioning the correct form of adjudication method. Or discuss at least four arguments in the support of your answer by mentioning the correct form of adjudication method.

      OBJECTIVE OF THE STUDY
      The objective of the activity is to understand the concept of litigation.

      After attempting this activity students will be able to;

      Understand the concept of litigation. Comprehend how to resolve conflict through litigation and its related advantages
      and disadvantages.
      THE STATE
      There are many ways to resolve conflicts including surrendering, running away, overpowering your opponent with violence, filing a lawsuit, etc. Dispute resolution processes can be divided into two main categories, negotiation and adjudication. In negotiation, the disputants decide the issue whereas in adjudication the neutral third party decides the issue. Lawsuit/Litigation is one of the kinds of adjudication. The litigation process starts with filing a complaint in court and typically resolved at a court trial before a judge or adjudicator.
      Baig Electronics and Paracha Electronics are immediate neighbors in an electronic market of a metropolitan city. Their owners had quarreled on a petty issue some time ago and the issue worsened and became difficult to resolve for both. Baig Electronics’ owner wants to resolve the conflict through negotiation or mediation whereas Paracha Electronics’ owner wants to resolve through the third party and filing a lawsuit against Baig Electronics.
      THE REQUIREMENT
      Being a student of Conflict Management subject, answer the following question; What are effective conflict resolution strategies to avoid litigation? Discuss at least 4 points/strategies. 4 Marks What will be the advantages of and disadvantages to Baig Electronics and Friends Electronics if they go for litigation to resolve the dispute? Discuss at least 2 each of the advantages and disadvantages of the litigation process. 6 Marks

      Ahmed is doing wholesale business of clothes in a metropolitan city. Akbar is a retailer doing business of clothes in the same city. Akbar is an old and regular customer of Ahmed and just on a phone call, Ahmed delivers clothes to Akbar at his business place as per his demand and always meets his expectation regarding quality of ordered clothes. This year, as the winter season was approaching, Akbar wanted to buy the seasonal clothes and ordered the required clothes on a phone call. Once the order delivered at his business place, Akbar was not satisfied regarding the quality of the received clothes. He immediately informed to the Ahmed but he said, within agreed price, he delivered the best quality clothes. Eventually, their long-term business relationship turns into conflict as Ahmed could not satisfy Akbar on the alternative offered prices of clothes and other best options.
